The PEF Code provides that when a caveat is
filed or some other dispute arises before the Register, the matter
may be certified, i.e., transferred, to the Orphans' Court at the
discretion of the Register or at the discretion of the Court upon
motion of a party in interest.
The Philadelphia Orphans' Court will not accept
Certification of Record until the Register has heard sufficient
testimony to conclude that a disputable and difficult question exists.
Certification lies within the discretion of the Orphans' Court,
but it is seldom granted upon motion of a party in interest in Philadelphia
County.
